Enrich Products, Inc. (“EPI”) filed the attached Answer, Affirmative Defenses and Counterclaims on March 29, 2016, denying wrongdoing and that LiquiTech is entitled to any of the relief it requested in the Second Amended Complaint.
In the Counterclaims, EPI asserts that LiquiTech engaged in federal false advertising, deceptive trade practices under Illinois law, and consumer fraud and deceptive business practices under Illinois law, seeking permanent injunction and monetary damages, among other remedies, based on claims that LiquiTech made numerous false and misleading descriptions and representations on its website relating to EPI and the parties’ copper silver ionization products and related services, likely influencing deceived customers’ purchasing decisions. EPI also asserts that LiquiTech is liable for false and misleading statements and omissions on Terra Marra International’s website endorsing LiquiTech’s copper silver ionization products and services.
EPI and LiquiTech market, sell, and distribute copper silver ionization systems, which kill, prevent and control Legionella bacteria in water systems, to hospitals, hotels, and other facilities. According to the Counterclaims, EPI’s copper silver ionization system is currently registered with the US EPA for the control of Legionella bacteria in drinking water.
